Who we are
Butter Auctions is a brand operated by Luxhaven Trading L.L.C. “Butter Auctions”, “we”, “us” and “our” refer to Luxhaven Trading L.L.C., a single-owner limited liability company registered in Dubai, United Arab Emirates, under trade licence 1537152 and commercial register 2669809. Our licensing authority is the Dubai Department of Economy and Tourism.
Our business and correspondence address is Luxhaven office, Gold & Diamond Park, Building 2, Unit 2219, 1st Floor, Sheikh Zayed Road, Dubai. Contact hello@butterauctions.ae for account, purchase, payment or complaint enquiries. Butter Auctions is the brand name, not a separate contracting company.
These terms govern use of butterauctions.ae, account services, bidding, purchases and selling enquiries. Read them with the relevant lot description, any expressly agreed sale or consignment terms, and our Privacy Policy. Mandatory UAE law takes priority over any conflicting provision.
Accounts and eligibility
You must be at least 18 years old and have full legal capacity under the law that applies to you. A person acting for a business must have authority to bind it. Registration requires a valid phone number, accurate contact details and an acceptable username. Keep your information up to date and do not impersonate anyone.
Keep your password and verification links private. Tell us promptly if your account or card may have been compromised. You are responsible for activity you authorise; responsibility for unauthorised activity is determined under applicable law. We may request proportionate identity, authority, ownership or payment checks before allowing a transaction.
An account does not itself entitle you to bid. Bidding requires verified email, a current verified card on file and any eligibility checks shown for the auction. Do not create extra accounts to evade restrictions.
The pieces we offer
Read the photographs, condition report, measurements, stated accessories, service history and any specific disclosures before bidding. Many pieces are pre-owned. Wear, disclosed repairs and expressly identified missing accessories form part of the description; “pre-owned” does not excuse an undisclosed defect or a materially inaccurate description.
Ask about anything material that is unclear and arrange a viewing when needed. Screen colours and approximate measurements may vary reasonably, but this does not remove your right to receive goods that match the agreed description. Manufacturer warranties apply only where expressly stated and transferable. Watches are not represented as water-resistant unless this is specifically confirmed.
Brand names identify the goods. Unless expressly stated, Butter Auctions is not affiliated with, endorsed by or an authorised dealer of the manufacturers. No estimate, previous sale price or commentary guarantees future value, investment returns or resale proceeds. Your statutory rights remain unaffected.
Bids and the sale contract
Review the lot, bid amount, buyer’s fee and total before confirming. A bid accepted by our auction system is a commitment to buy if it becomes the winning bid under the published auction conditions. A button click, pending request or email delay is not proof of acceptance. Check the accepted-bid confirmation and current auction record.
The highest valid accepted bid at the final closing time wins if the reserve, where applicable, is met. A reserve is the minimum price the seller will accept and may be undisclosed. If a reserve is not met, there is no winning purchase unless a separate offer is expressly agreed. The sale contract forms when the auction closes with a qualifying winning bid, subject to mandatory law and any express pre-bid sale condition.
Luxhaven Trading L.L.C. is the seller contracting with the buyer and is named on the buyer’s invoice, including where a piece is supplied to us on consignment. Any separate agreement with the consignor does not reduce our obligations to the buyer. Nomupay is the payment processor, not the seller.
Accepted bids cannot normally be withdrawn just because you change your mind. Contact us immediately about a genuine input error or suspected unauthorised bid. We will consider the evidence and applicable law; a cancellation is not effective unless confirmed. Nothing in these terms excludes a legal cancellation right.
Bidding limits and extended closing
Amounts are in UAE dirhams (AED). A bid may not exceed AED 5,000,000. A single bid may increase the current price by no more than AED 100,000; for an opening bid this increase is measured from the starting price. The minimum permitted bid and increment are shown before confirmation. These are platform limits, not a valuation of the piece.
Every valid bid accepted in the final 120 seconds adds 120 seconds to the existing closing time. This can repeat until a closing period passes without another qualifying bid. Rejected bids and duplicate requests do not extend the auction. The server’s receipt time, accepted sequence and closing record govern; the on-screen countdown is an aid and may be affected by your connection.
We do not guarantee uninterrupted internet access or acceptance of a last-second request. Bid early enough to receive confirmation. Where an actual system error or unlawful interference affects fairness, we may pause, investigate, correct or cancel the affected auction to the extent legally permitted, notify affected users and return sums due. This does not allow arbitrary cancellation of a valid sale.
Prices, fees and tax
The buyer pays the winning bid (the hammer price) plus a buyer’s fee of 7.50% of the hammer price. VAT on that fee is included in the 7.50%; it is not added again. For example, an AED 10,000 winning bid has an AED 750 buyer’s fee and an AED 10,750 total, before any separately agreed optional service.
The bid review shows the total payable for the sale and any applicable tax treatment. Optional delivery, insurance or other services require a separate disclosed price and your agreement. We do not add undisclosed compulsory charges after a bid. Your bank may apply its own currency-conversion or other bank charges.
Sellers pay no listing fee and no seller commission under our standard service. The hammer-price proceeds and any separately agreed optional costs are dealt with in the written consignment agreement. We provide transaction documentation and tax invoices where required by law.
Nomupay and your payment card
Nomupay is our payment processor for card services made available through Butter Auctions. Card information is entered through the processor’s secure payment interface. Butter Auctions receives a payment token, verification or transaction status and limited card details such as brand, expiry and last four digits; we do not receive or store the full card number or security code in our application.
Use only a card you own or are authorised to use. Your bank or Nomupay may require additional authentication or refuse a transaction. The supported card brands, payment methods, amount and currency are displayed at the payment step. Processing is subject to the relevant provider, card-network and bank rules, without reducing our obligations to you.
New card setup uses a temporary AED 10 preauthorization and creates a payment token. We request reversal of the verification hold and activate the saved card once Nomupay confirms the release. Your bank controls when the pending amount disappears. Card-storage consent is limited to this verification and token storage. Any purchase payment requires the amount and the relevant authorisation to be presented. Nomupay is not the seller of the piece and does not guarantee its condition or the outcome of an auction.
When the bid review requests a buyer’s fee hold for a single bid, confirming it authorises a preauthorisation equal to 7.50% of your bid. Your highest accepted bid determines the hold for that auction. A higher accepted bid replaces the earlier hold, and your bank may temporarily display both while the earlier hold is released. Rejected bids have their associated new hold released. At auction close, the winner’s 7.50% fee is captured and other bidders’ holds are released. The winning bid amount remains payable at the Luxhaven office. Release timing depends on your bank.
You may instead choose a bidding limit for one auction and expressly approve a hold equal to 7.50% of that limit. Each bid still requires your confirmation. The approval can cover subsequent bids within the limit for up to six hours, subject to account, card and auction eligibility. A higher limit or a renewed approval may require another bank verification. If you win, we capture only 7.50% of your actual winning bid and request release of the unused hold. If you lose or the reserve is unmet, we request release of the full hold at auction close. An unsuccessful bid within an existing limit does not cancel the hold backing earlier accepted bids. Your bank determines the authorization lifetime and release timing.
The saved card cannot be removed through account controls while you have an outstanding bid-related hold, a leading bid or an unsettled winning bid. Contact us if it is compromised, replaced or must be removed. We may need an eligible replacement or resolution of the commitment. This does not restrict your rights against your card issuer.
Payment and failure to pay
The winning buyer must pay the confirmed total within 48 hours after the auction closes, unless a different period was expressly agreed before bidding. Follow the verified payment instructions in your account or issued by us. A card verification, screenshot or pending bank transfer is not cleared payment.
We may withhold release of the piece until funds have cleared and necessary checks are complete. If payment fails, contact us promptly. After reasonable notice, and where the law permits, we may restrict further bidding, cancel an unpaid sale or arrange a resale. We may seek reasonable, documented loss directly caused by a proven breach, subject to our duty to mitigate loss and applicable law; there is no automatic penalty or unrestricted right to debit your card.
Raise a payment error or disputed transaction promptly with us so we can investigate. This does not require you to give up or delay a lawful complaint, refund claim or card chargeback. Fraudulent payment claims and deliberate misuse of the dispute process are prohibited.
Collection, inspection and delivery
Our standard service is collection by appointment at the Luxhaven office, Gold & Diamond Park, Building 2, Unit 2219, 1st Floor, Sheikh Zayed Road, Dubai, after cleared payment. Contact us within seven calendar days of the auction closing to agree a collection date. The appointment is confirmed in writing; do not travel before confirmation. Standard office collection carries no separate delivery charge.
Bring the identification or representative authorisation reasonably requested for release. Inspect the piece, its condition and included accessories before accepting it. Tell us about any discrepancy at collection and allow us to record and investigate it. Signing a collection receipt confirms delivery, not a waiver of rights for hidden defects, authenticity issues or legal non-conformity.
Ownership passes only once cleared payment has been received and the piece is released to you or your authorised recipient. Risk remains with the party responsible under applicable law until handover. Seller proceeds are released after cleared payment and buyer acceptance, subject to unresolved disputes, refund obligations and the consignment agreement. This is not represented as a regulated escrow or deposit service.
Shipping is not included in the standard service. If available, the destination, carrier, expected dispatch/delivery timing, insurance, charges and responsibility for customs must be separately agreed before a shipped purchase is concluded. We do not impose undisclosed storage fees or treat an uncollected piece as abandoned automatically.
Cancellations, returns and refunds
There is no additional voluntary change-of-mind return policy for completed auction purchases unless we expressly agree one. This does not exclude a cancellation, repair, replacement, refund, compensation or other remedy that applicable law gives you, including for counterfeit goods, undisclosed defects, material misdescription, non-delivery or a service not provided as agreed.
Notify hello@butterauctions.ae as soon as reasonably possible with the lot or order reference, a description of the issue and supporting photographs or documents if available. No short reporting period in these terms extinguishes a statutory right. We may arrange a reasonable inspection or independent assessment and provide secure return instructions. Do not send valuable goods to an unconfirmed address.
Keep the piece and supplied accessories safe while a claim is investigated. Avoid use, repair, alteration or disposal that could worsen the issue or prevent assessment. Any effect of damage or use on a remedy will be assessed under applicable law; opening packaging or discovering a hidden issue after collection does not automatically defeat a claim.
Where the sale is cancelled by us or unwound under a legal refund entitlement, we return the sums due, including the buyer’s fee and applicable tax for the cancelled purchase. Required return costs are borne as the law requires. Refunds are normally made to the original payment method or, where this is impossible, through an agreed lawful alternative after identity checks. We do not insist on store credit instead of a cash refund where a monetary refund is due.
We process refunds without undue delay and within any applicable legal deadline, and confirm the amount, initiation date and expected processing time. The card issuer or bank controls when the credit appears. A processor delay does not remove our responsibility to pursue a refund that we owe.
Selling and consignments
A selling enquiry or indicative valuation does not commit either party to a sale. Acceptance of a piece requires verification and a separate written consignment or purchase agreement covering ownership, reserve, sale authority, custody, payout, withdrawal and any optional costs.
You must own the piece or have documented authority to sell it, with good title free of undisclosed security interests or competing claims. Provide accurate identity, provenance, authenticity, repair and condition information. Do not submit stolen, counterfeit, illegally imported or otherwise unlawful goods.
You must not bid on your own piece, instruct another person to do so, collude with bidders or manipulate demand. We may reject a submission or hold a transaction for a proportionate investigation or legal requirement. Where a seller’s proven breach causes loss, we may seek lawful, reasonable and documented recovery under the consignment agreement; no undisclosed blanket indemnity or penalty is imposed by these terms.
Fair use and security
Do not use Butter Auctions for fraud, money laundering, sanctions evasion, harassment or unlawful trading. Do not submit false documents, manipulate bids, bypass account or bidding limits, scrape personal information, introduce malicious code, interfere with availability or probe systems without our written authorisation.
We may restrict access where reasonably necessary to protect users, investigate credible misuse or comply with law. We will give a reason and an opportunity to contact us where lawful and practicable. Restrictions are proportionate and do not cancel amounts owed to you or your rights in an existing transaction. We may preserve relevant records and respond to lawful authority requests.
Content and intellectual property
The Butter Auctions name, logo, original photographs, written material and site design belong to Luxhaven or their respective rights holders. You may use the site and retain transaction documents for your own lawful purposes. Reproducing our content commercially, misrepresenting an association with us or using our marks without permission is prohibited, subject to legal exceptions.
You retain rights in material you submit. You give us permission to use the material only as reasonably needed to assess, describe, market and administer your submitted piece, answer enquiries, handle disputes and meet legal requirements. You must have the necessary rights and must not publish another person’s private information without a lawful basis.
Responsibility and events outside our control
We will provide our services with the care required by law. We do not promise uninterrupted access, a particular selling price or investment performance. Responsibility for an internet outage, bank refusal or other event depends on its cause, our obligations and applicable law; an external provider does not automatically excuse our own failure.
Neither party is responsible for delay caused solely by an event genuinely beyond its reasonable control to the extent permitted by law, provided it takes reasonable steps to limit the effects and informs the other party when a transaction is affected. If performance cannot lawfully continue, cancellation and refund rights remain available.
Nothing here excludes liability for fraud, deliberate wrongdoing, gross negligence, a title or authenticity obligation, death or personal injury where liability cannot be limited, or any other non-excludable liability. We do not exclude or cap statutory consumer remedies. Claims for loss must be supported and are assessed under applicable UAE law.
Privacy and communications
Our Privacy Policy explains how account, identity, auction and payment-related information is used and shared. Nomupay processes card information and related transaction data under its applicable privacy notice. We may send necessary security, verification, bid, payment and service messages using your registered contact details. Agreement to these terms is not consent to unrelated marketing.
Tell us when your contact details change. Electronic confirmations and records may be used as evidence where the law permits, but are not made conclusive or immune from challenge by these terms. You may save or print this page for your records.
Complaints and applicable law
Send a complaint to hello@butterauctions.ae, addressed to Luxhaven Trading L.L.C., with the transaction reference and the outcome you seek. We will acknowledge it and investigate promptly, asking only for information reasonably needed. You may also use the Dubai Department of Economy and Tourism consumer-complaint service or any other competent authority. Contacting us first is encouraged but is not a condition of exercising a legal right.
These terms are governed by the federal laws of the United Arab Emirates and the laws applicable in the Emirate of Dubai. Disputes may be brought before the competent Dubai courts, without depriving a consumer of any mandatory right to another competent forum. We do not impose mandatory arbitration or a waiver of lawful complaints.
Language and changes to these terms
These terms are available in English and Arabic. The Arabic version applies where Arabic is required by UAE law. Any inconsistency is resolved under mandatory law and applicable consumer protections; a translation cannot remove a non-excludable right.
We may update terms for future use and transactions by publishing a dated version and giving additional notice or seeking agreement where required. An update does not retrospectively change an accepted bid, completed sale or accrued right. If a provision is invalid, the remaining provisions continue only to the extent legally permissible. Failing to enforce a right immediately does not by itself waive it.
